Does Microsoft 365 Copilot make us Privacy Act 1988 compliant?

Does Microsoft 365 Copilot make us Privacy Act 1988 compliant?

No — Copilot is a tool that can support compliance, but compliance is a posture, not a product. The Privacy Act 1988 applies based on how your business handles personal information, not on which tools you use. Copilot can help you handle information better, but it can also help you handle it worse if it’s misconfigured.

Owners often want a single answer to “are we compliant?” — but compliance is a continuous practice, not a checkbox. The Privacy Act covers organisations with $3M+ turnover, plus health service providers regardless of revenue, plus a few other categories. Privacy Act compliance involves:

  • Knowing what personal information you hold
  • Limiting collection to what you need
  • Protecting it (security)
  • Giving people access to their information
  • Having a Privacy Policy
  • Notifying the OAIC + affected individuals if a breach happens

Copilot doesn’t do any of those for you. But Step 2 of our Roadmap (sensitivity labels, data classification, access reviews) is meaningful Privacy Act work that has the side effect of being good Copilot prep.

Our Foundation step includes a Privacy Act 1988 review tailored to your sector — what applies, what gaps exist, what to do. Plus the technical controls (sensitivity labels, audit logging) that demonstrate compliance to a regulator if asked.
